TERMS AND CONDITIONS

1. Acceptance of Terms
By accessing the Class Marine website (www.classmarine.ae) and/or engaging our services, you agree to comply with and be bound by these Terms & Conditions. If you do not agree, you must not use our website or services. Class Marine reserves the right to update or amend these Terms at any time. Continued use of the website or services constitutes acceptance of the revised Terms.

2. Service Requests, Quotations & Agreement
     2.1 Service Requests
Service requests may be made online, by telephone, or in person. All requests are subject to inspection and acceptance by Class Marine.
     2.2 Quotations
           • Quotations are estimates only and are not binding until accepted in writing
           • Final pricing may change due to:
              â—¦ Actual vessel condition upon inspection
              â—¦ Additional or hidden defects discovered during service
              â—¦ Changes in scope requested by the customer
              â—¦ Parts availability, supplier pricing, or labor requirements
              â—¦ Emergency, urgent, or after-hours services
Any variation from the original quotation will be communicated to the customer for approval.
     2.3 Commencement of Work
Class Marine may require a deposit or advance payment before commencing work. Work will begin only after acceptance of the quotation and receipt of any required advance payment.


3. Payment Terms
• All prices are in AED unless stated otherwise
• Payment methods include cash, credit card, bank transfer, and cheque
• Invoices are payable immediately upon presentation unless otherwise agreed in writing
• Class Marine reserves the right to withhold delivery of the vessel until full payment is received
• Late payments may result in work suspension and additional charges


4. Delays, Storage & Abandonment
• Completion timelines are estimates and may vary due to parts availability, supplier delays, weather conditions, or technical complexity
• Class Marine is not liable for delays beyond its reasonable control
• Storage or parking charges may apply if the vessel is not collected within the agreed period after job completion
• Vessels left unpaid or uncollected for extended periods may be treated as abandoned, and
Class Marine reserves the right to recover costs in accordance with UAE law


5. Customer Responsibilities
Customers agree to:
• Provide accurate and complete information about the vessel
• Disclose all known defects, modifications, or prior damage
• Maintain valid insurance coverage for the vessel at all times
• Remove personal belongings before service (Class Marine is not responsible for loss or theft)
• Provide safe and timely access to the vessel
• Comply with safety instructions and marina regulations
• Pay all invoices as agreed


6. Liability & Risk
     6.1 During Service
           • Class Marine is not responsible for pre-existing damage, corrosion, wear and tear, or latent defects
           • Reasonable care will be exercised; however, marine services inherently involve risk, and minor incidental damage may occur
           • Class Marine shall not be liable for damage caused by structural weakness, aging components, or undisclosed conditions
     6.2 Insurance
Customers acknowledge that Class Marine does not provide insurance coverage for customer vessels. Any loss or damage should be claimed under the customer’s own insurance policy.


7. Warranty
     7.1 Workmanship Warranty
Workmanship warranty is provided only for selected services, as expressly confirmed in writing by Class Marine at the time of quotation or invoicing. This warranty applies solely to defects arising directly from Class Marine’s workmanship and does not cover:
           • Services for which no workmanship warranty is specifically stated
           • Normal wear and tear
           • Environmental effects, including corrosion, oxidation, and saltwater exposure
           • Damage resulting from misuse, negligence, improper operation, or lack of maintenance
           • Unauthorized repairs, modifications, or alterations performed by third parties
           • Pre-existing conditions or defects not identified during the service
All warranty claims are subject to inspection and approval by Class Marine. Class Marine reserves the right to repair, re-perform, or otherwise remedy the warranted service at its sole discretion.
     7.2 Parts Warranty
Parts are covered solely by the original manufacturer’s warranty, where applicable.
     7.3 Disclaimer
Except as expressly stated, all warranties—express or implied—are excluded to the maximum extent permitted by UAE law.


8. Limitation of Liability
To the fullest extent permitted by law:
• Class Marine’s total liability shall not exceed the amount paid for the specific service
• Class Marine shall not be liable for indirect, incidental, or consequential damages, including loss of use, profit, or business
• These limitations apply regardless of the legal basis of the claim


9. Right to Refuse or Limit Service
Class Marine reserves the right to:
• Refuse or discontinue service at its discretion
• Cancel or reschedule appointments with reasonable notice
• Decline work that may compromise safety, legality, or professional standards


10. Intellectual Property & Website Use
All website content, logos, images, and materials are the property of Class Marine and may not be copied or used without prior written consent. Unauthorized use of the website is prohibited.

11. Indemnification
You agree to indemnify and hold harmless Class Marine, its owners, employees, and agents from any claims, losses, or liabilities arising from:
• Your breach of these Terms
• Your vessel or its operation
• Violation of laws or third-party rights


12. Force Majeure
Class Marine shall not be liable for failure or delay caused by events beyond reasonable control, including natural disasters, government actions, labor shortages, or supply-chain disruptions.

13. Governing Law & Dispute Resolution
These Terms are governed by the laws of the United Arab Emirates. Any disputes shall first be resolved through good-faith negotiation. If unresolved, disputes shall fall under the exclusive jurisdiction of the courts of Abu Dhabi.

14. Severability
If any provision is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
